The masterclass focuses on the wide range of ocean towage and salvage agreements provided by BIMCO. This course focusses on practical solutions and ways for the parties to allocate risks and obligations.
Some of the topics the course will cover are:
The sessions are structured as a walk-through of the charterparties. The trainers will discuss and involve the participants in an exchange of experiences, working practically with amended versions of the contracts.
The ROGER ALPHA was built in Norway in 1970 as a semi-submersible drilling platform. The previous owner went bankrupt and the rig was repossessed by the bank as security. After having been laid up in Singapore for 14 months, the bank has now sold the rig to Bravo Marine Inc., Monrovia. Liberia “As is, where is” Singapore. The owners of the platform scan the market for the least costly option for having the rig towed to West Africa, where they are working on various options to employ the platform.
The platform owners eventually conclude a TOWCON contract with the owners of the HAPPY PULLER, built in the USA in 1979 as a pusher tug. Nearing the end of her trading life, she has not been trading very much the last two years and has been laid up off the west coast of India for an extended period with her class expired. The owner Oak Tree Inc. brings her out of lay-up when they enter in negotiations to deliver the ROGER ALPHA from Singapore to West Africa.
As the case study unfolds, it becomes obvious that the HAPPY PULLER may not have been the best option for the project. Questions, will be asked such as:
Working jointly with participants from the towage and salvage industry, BIMCO has created a range of practical, flexible contracts, used world-wide for ocean towage and salvage. This is an opportunity to learn from BIMCO how the contracts continue to develop and are being used for multiple purposes. This is combined with hand-picked industry experts who have built a career out of solving disputes involving towage and salvage.
The combination of theory, discussion and casework will make the complexity of ocean towage and salvage clear and manageable. The trainers will share valuable experiences and point participants towards practical solutions that can be used on the job. The course will also facilitate networking between international shipping peers and enable long-term relationships between the participants.
The Masterclass is aimed at all practitioners involved in ocean towage and salvage, who wish to boost their expert knowledge and become proficient in understanding how the contracts work, also when used for other purposes than originally intended.
The course will equip you with a much deeper understanding of the fundamental challenges related to ocean towage and salvage. It will provide you with a balanced understanding of the relevant legal principles and practises. The course will help you identify the potential challenges in advance and enable you to ask the right questions to the parties involved. This will help you to understand and explain your own risks and exposure and allow you to discuss issues surrounding allocation of risks and the legal relationships with your customers, superiors, P&I club or legal counsel.
Participants will be given an option of taking a final assessment (1-hour open-book test) at the end of the course, and Certificate of Achievement will be issued with a grade (distinction, merit or pass). Those not taking the assessment will receive a Certificate of Attendance.
BIMCO issues electronic course files as an Adobe PDF file enabling you to make personal notes using a computer or tablet. Please bring a computer or tablet! All documentation and presentations will be in English.
The fee includes coffee breaks, lunch and course materials, but not transport or accommodation, which should be arranged by the participant directly with the hotel.
