Voyage charters are not regulated by compulsory international conventions. This course highlights problem areas, presents ways for parties to allocate risks and gives an overview of the relevant legal principles.
What will you learn?
Some of the topics the course will cover are:
- The nature of a voyage charters
- The relationship between voyage charters and other trading and carriage contracts
- The owners and charters duties
- The nature and purpose of liens on cargo and on sub-freights
- Defences to liability
The crew of a tanker finds themselves in the middle of the devastation of a huge refinery. During the loading operations a powerful earthquake strikes, destroying or damaging infrastructure in and around the port. With only around half the cargo onboard, the tanker disconnects mooring lines and hoses and drop anchor, awaiting further instructions from the charterers. After a period at anchor, the vessel departs. Subsequently, the owners submit a claim for dead freight and demurrage. Will the claim succeed? And how much demurrage (if any) is the owner entitled to receive?
In the case studies, you will work in small groups to consider scenarios and a range of problems that may arise. The cases will form a basis for dialogue and will help the participants understand the relevant legal principles, practise and reallocation of risk.
