Anti Corruption Clause for Charter Parties 2015

The Anti-Corruption Clause for Charter Parties 2015 provides market users with a regime for responding to unlawful demands for gifts in cash or kind, such as cigarettes or alcohol. It is designed for use in both voyage and time charters and sets out a series of steps with the contracting parties working together to resist such demands but if this fails, owners’ rights to hire or uninterrupted laytime and demurrage are protected. Termination, by either party, is the ultimate sanction but a high threshold has been set so that it cannot be easily used as an exit from an inconvenient charter. This clause was published on 7 December 2015.

GENCOA

The GENCOA is BIMCO’s standard contract of affreightment for dry bulk cargoes. A contract of affreightment is an agreement between an owner and a charterer for the carriage of a certain amount and type of goods between agreed ports over a given period of time. It is not limited to a particular ship, but operates as a series of voyage charter parties. GENCOA has been designed to be used with any dry cargo charter party, although BIMCO would recommend the use of GENCON, COAL-OREVOY or GRAINCON. The latest edition of this contract is GENCOA from 2004. Copyright in GENCOA is held by BIMCO.

Laytime Definitions for Charter Parties 2013

The Laytime Definitions for Charter Parties have been developed to provide practitioners with a set of meanings of commonly used words and phrases. The objective is to help reduce disputes about party intentions in a market where fixtures are often concluded on the basis of a recap message and listed amendments, without the exchange or return of draft contracts. These provisions have been developed for incorporation into charter parties. The latest edition of these definitions is the Laytime Definitions for Charter Parties 2013.

PROJECTCON

PROJECTCON is a special projects charter party for the tug and barge sector. It was designed to remove the need to use up to three different contracts for the same project when operating a tug and semi-submersible barge in combination to transport of special or projects cargoes. Instead of having one contract for the hire of the barge, another for the hire of the tug, and a third for the transportation, PROJECTCON may be used as a single contractual platform.
