ASVTIME

ASVTIME is a time charter party for accommodation support vessels (ASVs) engaged in the offshore oil and gas and renewables sectors. The charter party is based on SUPPLYTIME 2017 and operates on a knock for knock liability regime, which means that each party agrees to bear responsibility for and indemnify the other in respect of loss of or damage to their own property, and injury to or death of their own personnel, regardless of fault. ASVTIME incorporates several features from WINDTIME, including a contractual limitation of liability. Tailormade provisions have been introduced catering for the specificities of the ASV sector, such as provisions dealing with optional equipment, parallel operations and offshore bunkering of crew transfer vessels. The latest edition of this contract is ASVTIME, issued in 2021. Copyright in ASVTIME is held by BIMCO.

Cyrille De Salins has extensive experience in the shipping and offshore industries. Cyrille was an associate with Ince & Co France for more than 8 years, where he focused on disputes arising from carriage of goods, charterparties, bills of lading, shipbuilding, total loss, collisions, salvage, general average, groundings and limitation of claims. He has particular experience of drafting and negotiating a wide range of contracts in the offshore energy and marine sectors, including BIMCO SUPPLYTIME, WINDTIME, HEAVYLIFTVOY and other standard contracts, as well as bespoke contracts. Cyrille now works as a senior legal counsel at Siemens Gamesa Renewable Energy A/S, where he supports the preparation, drafting, negotiations and handling of complex agreements and charterparties to carry, install and service wind turbine components across the globe. He is qualified in France and in England and Wales.

ASV specific features tackled in new charter party

The subcommittee developing a standard time charter party for accommodation support vessels (ASVs), at an online meeting on 23 April, continued discussions on key areas of the new contract, including offshore bunkering and how to address the concept of immediate tasks in an ASV specific context.

BIMCO adopts new tug, barge and “floating hotel” contracts

BIMCO has extended its library of offshore industry standard contracts with the adoption of ASVTIME – a time charter party for accommodation support vessels. Updates of BIMCO’s ocean towage agreements – TOWCON and TOWHIRE – have also been adopted along with a new edition of its charter party for hiring unmanned barges – BARGEHIRE.

Revised Charter Party Guarantee adopted by Documentary Committee

At its meeting in Copenhagen on 16 November, BIMCO’s Documentary Committee adopted a revised version of its standard Charter Party Guarantee. The Charter Party Guarantee 2022 is an up-to-date, clearly worded and comprehensive time charterers’ guarantee for all sums payable and liabilities under a time charter party.

Paul has spent 14 years working in shipping and Admiralty matters. Prior to this Paul was at sea for 16 years with the last 9 years in the offshore sector, including taking command roles in DP classed vessels. Paul qualified as a solicitor in 2009 and advised on LOF and common law salvages around the UK as well as contractual disputes under the various towage contracts such as the UKSCT, TOWCON and TOWHIRE and equally SUPPLYTIME. He has regularly advised on the drafting and implementation of wreck removal contracts, acting for contractors as well as Clubs. He also gives seminars to clients on the various BIMCO and ISU contracts to assist them in choosing the most appropriate contract for their particular circumstances. Paul has recently been elected as the Secretary to the Admiralty Solicitors Group (ASG). The ASG is comprised of established maritime legal firms and was formed in 1972 to promote and preserve standards in the practice of maritime law in England. The ASG meets regularly to discuss recent issues and maritime practice.

Documentary Committee adopts string of important contracts and clauses

When BIMCO’s Documentary Committee (DC) met on 11 October in Copenhagen, it approved two new clauses and two revised versions of existing contracts. The new standards are being finalised for publication and will soon be made available for use on SmartCon and on the BIMCO website accompanied by explanatory notes.

He focuses on disputes arising from installation contracts, charter parties, bills of lading, shipbuilding, rig disputes, towage, collisions, salvage, general average, groundings, total loss, and limitation. Clients he advises include: energy companies, cable owners and operators, contractors, shipowners, charterers, shipyards, ship managers, brokers, and insurers / P&I Clubs. His experience extends to all the major arbitral institutions including LCIA, ICC, SIAC, SCMA, LMAA, ad hoc arbitration, and the English courts. Nicholas has particular experience of drafting and negotiating a range of contracts in the offshore energy and marine sectors, including BIMCO SUPPLYTIME, TOWCON and BARGEHIRE, LOGIC contracts, and other standard contracts, as well as bespoke contracts. Since joining HFW, Nicholas has undertaken secondments in Australia (to HFW's Perth Office with a focus on the Offshore / Oil & Gas / Commodities sectors), to the in-house legal team of a major international tanker owner, to an International Group P&I Club / Insurer, and a leading insurance broker. Nicholas is qualified in England and Wales.
