BIMCO updates New York and Singapore arbitration clause options

A new edition of BIMCO’s Dispute Resolution Clause has been published. New wording has been added to the US law, New York arbitration option to ensure that non-maritime contracts (such as shipbuilding contracts) are not inadvertently excluded from the scope of the clause.

Andrew is a partner at the Hong Kong office of Stephenson Harwood. Andrew is a specialist in marine and international trade matters, including shipbuilding and construction, installation and operation of offshore structures. He is an expert in arbitration, litigation and mediation and is the head of the marine and international trade team in Hong Kong. Andrew has a wide range of experience in dry shipping and international trade and trade finance dispute resolution. He has represented clients in the English and Hong Kong high courts and courts of appeal, in arbitrations in London and Hong Kong and has conducted numerous mediations. He is familiar with LMAA, ICC, HKIAC and GAFTA arbitrations. Andrew has particular experience in jurisdiction disputes and in obtaining injunctions in support of litigation and arbitration.

Stig Gregersen graduated in law in 1981 from the University of Copenhagen and joined Assuranceforeningen SKULD and Danish Defence Club the same year. Stig was appointed Vice President in 2000 and he has been dealing with all types of P&I claims and FD&D disputes. Further, Stig obtained a Master’s in Mediation and Conflict Resolution from the University of Copenhagen in 2004 and since then he has mediated approximately 150 disputes. After 37 years with Assuranceforeningen SKULD, Stig joined the legal department of Clipper Bulk A/S in 2019 until 2022 where he has assisted with all kinds of contracts and disputes. During his time in Assuranceforeningen SKULD and Clipper Bulk A/S, Stig has lectured on maritime and mediation topics in Denmark and abroad on a regular basis.

New BIMCO Law & Arbitration Clause under way

BIMCO has started work to develop a new Law & Arbitration Clause. The new clause will provide a short and “one size fits all” approach to dispute resolution, while adding Hong Kong as the fourth named arbitration venue. The addition of Hong Kong reflects its increased popularity as a centre for dispute resolution and that it is currently ranked among the top maritime arbitration centres in the world.

Law and Arbitration Clause 2020 London

The Law and Arbitration Clause 2020 replaces the Dispute Resolution Clause 2017. There are versions available for four named arbitration venues – London, New York, Singapore and Hong Kong. The mediation provision found in earlier versions of this clause has been removed and made into a free standing clause that parties can incorporate by choice. The Law and Arbitration Clause 2020 consists of five short subclauses. Adopted 21 September 2020
