SHIPMAN revision well underway

BIMCO is revising its popular suite of ship management and related third-party management agreements to reflect current practices in the market. First in line is SHIPMAN 2009, BIMCO’s standard form ship management agreement that may include crew, technical and commercial management as well as insurance arrangements in respect of a ship.

The new edition of BIMCO's popular ship management contract SHIPMAN is out. SHIPMAN 2024 is the culmination of a thorough, two-year review process by a team of experts within the ship management sector who have taken into account changes in ship management practices since the contract was last revised in 2009 and included a significant number of freestanding BIMCO clauses that are typically added as riders to SHIPMAN 2009.

First draft of revised SHIPMAN ready for review by Documentary Committee

The drafting team tasked with the revision of BIMCO’s suite of ship management and related third-party management agreements met in London last week to continue discussions on the revision of SHIPMAN, the widely used standard ship management agreement last updated in 2009. The draft is now ready for a first review by BIMCO’s Documentary Committee when it meets in April.

Revision of SHIPMAN begins with focus on shipmanagers’ responsibilities under the EU Emissions Trading System

The drafting team tasked with updating BIMCO’s 13 year old SHIPMAN shipmanagement agreement will begin by preparing a free standing clause addressing the shipmanagers’ role in complying with emissions trading systems such as the EU ETS. ETS is seen as a critical issue by shipmanagers who will need to agree with owners how the surrender of emissions allowances for ships trading to the EU after 2024 is to be handled.

The subcommittee tasked with the revision of BIMCO’s suite of third party management contracts continues its work to develop a standard Emission Trading Scheme Allowances (ETSA) Clause for use with the popular ship management agreement SHIPMAN. The aim is to present a draft standalone clause for possible adoption by BIMCO’s Documentary Committee when it meets next in Copenhagen on 11 October.
