The CEMENTVOYBILL is a charter party bill of lading to be used with the CEMENTVOY charter party for the transportation of bulk cement. The latest edition of this bill of lading is CEMENTVOYBILL 2016. This amended edition incorporates the International Group of P&I Clubs/BIMCO Himalaya Clause for Bills of Lading and other contracts 2014, an updated layout and signature box, and a reference to the York-Antwerp Rules 2016 in respect of the Rules according to which General Average should be adjusted. Matt Hannaford

Matt is a partner of Hannaford Turner, having previously worked at Curtis Davis Garrard (2014-2016), Clyde & Co (2005-2014) and Clifford Chance (1993-2005). Matt’s practice focuses on commercial shipping law with particular expertise in ship finance and ship sale and purchase, including newbuilding projects. He is the co-author of Goldrein’s “Ship Sale and Purchase”, the leading legal textbook on the sale and purchase of secondhand tonnage. He was a member of the BIMCO documentary sub-committee for the preparation of Norwegian Saleform 2012. His clients include shipowners and operators, major international banks, ship builders, commodity traders and private equity funds. In addition to ship finance work, he regularly advises international maritime clients on mergers and acquisitions, joint-ventures and pooling arrangements. In recent years Matt has been heavily involved in debt finance restructurings, fleet enforcements and advising on insolvency issues. Matt is also recognised for his expertise in the superyacht market and regularly represents owners, builders and international financial institutions in this unique market sector.

Elizabeth is Senior Associate at Stephenson Harwood Hong Kong.  Elizabeth is a lawyer qualified in Hong Kong, England and Wales, and Australia. She has been based in Hong Kong since 2008. Elizabeth has significant experience on the wet side of shipping, having worked on a number of high profile casualties and groundings across the Asia Pacific region. Other particular areas of expertise include jurisdictional challenges and forum disputes, limitation of liability, maritime insolvencies, disputes involving the carriage of goods by sea, and trade finance and banking disputes with maritime law elements. Elizabeth has litigated in the Courts of Hong Kong, England, and Australia. She has also acted in a large number of international arbitrations, and has managed litigation and enforcement proceedings on behalf of clients in jurisdictions including the PRC, Singapore, Taiwan, Bangladesh, Indonesia, India and the United States.  Legal500 describes her as “a knowledgeable and effective litigator”.

New BIMCO Law & Arbitration clause will clarify arbitration processes

If a contractual dispute escalates and one of the parties want to involve arbitrators, it is essential that notices of commencement of proceedings and the appointment of arbitrators are properly served to the right people. BIMCO’s new Law & Arbitration Clause will address these issues with a provision requiring parties to a contract to clearly identify who are authorised to receive arbitration notices and communication.
