Remember the BIMCO Electronic Signature Clause

Published: 07 August 2024

Signing charter parties and other maritime contracts electronically is an effective and easy way to conclude agreements which has the advantage of saving time and costs and reducing the risk of fraud.

For these reasons, and in view of the continuously increasing digitalisation of the shipping industry, BIMCO published a standard clause in 2021 developed for inclusion in charter parties and other contracts making it possible for the parties to sign contracts electronically.

The standard - the BIMCO Electronic Signature Clause 2021 - enables the parties to sign a contract, and any documents to be signed in connection with it (such as bills of lading), electronically. The clause has been developed for use in any type of contract and allows the parties to obtain a physically signed contract in case they need it, for example, in a jurisdiction that does not recognise electronic signatures.
