The masterclass focuses on the wide range of ocean towage and salvage agreements provided by BIMCO. This course focusses on practical solutions and ways for the parties to allocate risks and obligations.
What will you learn?
Some of the topics the course will cover are:
- General introduction to TOWCON 2008/TOWHIRE 2008
- BARGEHIRE 94/2008 and BARECON
- Overview of the most used contracts in the salvage industry: SALVCON 2005, SALVHIRE 2005, WRECKHIRE 2010, WRECKSTAGE 2010, WRECKFIXED 2010
- Knock-for-knock and general issues of insurance
- Principles of contract law and their relevance to towage and salvage contracts
The sessions are structured as a walk-through of the charterparties. The trainers will discuss and involve the participants in an exchange of experiences, working practically with amended versions of the contracts.
The ROGER ALPHA was built in Norway in 1970 as a semi-submersible drilling platform. The previous owner went bankrupt and the rig was repossessed by the bank as security. After having been laid up in Singapore for 14 months, the bank has now sold the rig to Bravo Marine Inc., Monrovia. Liberia “As is, where is” Singapore. The owners of the platform scan the market for the least costly option for having the rig towed to West Africa, where they are working on various options to employ the platform.
The platform owners eventually conclude a TOWCON contract with the owners of the HAPPY PULLER, built in the USA in 1979 as a pusher tug. Nearing the end of her trading life, she has not been trading very much the last two years and has been laid up off the west coast of India for an extended period with her class expired. The owner Oak Tree Inc. brings her out of lay-up when they enter in negotiations to deliver the ROGER ALPHA from Singapore to West Africa.
As the case study unfolds, it becomes obvious that the HAPPY PULLER may not have been the best option for the project. Questions, will be asked such as:
- Was the HAPPY PULLER seaworthy, suitable and fit for the towage?
- Did the owner of the rig exercise due diligence in selecting which company to perform the towage operation?
