Technical and regulatory aspects of the 2020 global fuel sulphur limit are major concerns to the industry ahead of 1 January 2020. The course focuses on all aspects including bunker clauses.
Some of the topics the course will cover are:
If owners have fitted the scrubber and shared the costs with time charterers, should charterers have any liability if the scrubber breaks down? Does MARPOL Annex VI permit the ship to continue trading if the scrubber breaks down?
Installation of scrubbers may cause a range of unforeseen contractual consequences, the results of which can be difficult to predict both for owners and charterers. What issues can arise? In a short workshop, all participants will work in groups to answer one question per group. The result of all the workshops we conduct worldwide will be shared between all the participants.

After the course, you will have a have a better understanding of the need to incorporate suitable clauses, such as the BIMCO 2020 Fuel Transition Clause for Time Charter Parties and the 2020 Marine Fuel Sulphur Content Clause for Time Charter Parties. These clauses provide a commercial approach to apportionment of liability for some of the key issues arising out of the change in regulation.
