The New York Produce Exchange Form (NYPE) is the most widely used standard time charter party in the dry cargo sector. NYPE 2015 was developed in cooperation between BIMCO, the Association of Shipbrokers and Agents (ASBA), who are the copyright holders of the form, and the Singapore Maritime Foundation (SMF). POOLCON B is designed for use by tramp pools operating in the dry and liquid bulk trades under contracts of affreightment, spot or time charters to third parties. It governs the relationship between owners entering their ships into the pool and the pool managers and regulates administrative and procedural matters covering pool operations together with the allocation of respective party liabilities and obligations. POOLCON A is designed for use by tramp pools operating in the dry and liquid bulk trades under contracts of affreightment, spot or time charters to third parties. The purpose of the agreement is to achieve the benefits of efficiency for users and their customers without creating restrictions on trade. Pool members’ ships are time-chartered to the pool and it is the underlying time charter that provides the basis of the trading relationship between the ship owner and the pool. The Standard Naval Exercise Contract, NAVEXCON, was developed for the short-term charter of merchant ships to participate in military navigational exercises. In order to properly train military personnel in navigation techniques and to familiarise them with the handling of modern merchant tonnage, regular training exercises are conducted by many navies. This type of training is also useful for familiarising merchant navy personnel with the sort of pilotage techniques likely to be encountered in time of conflict. The latest edition of this contract is NAVEXCON, issued in 1996.
The GENCOA is BIMCO’s standard contract of affreightment for dry bulk cargoes. A contract of affreightment is an agreement between an owner and a charterer for the carriage of a certain amount and type of goods between agreed ports over a given period of time. It is not limited to a particular ship, but operates as a series of voyage charter parties. GENCOA has been designed to be used with any dry cargo charter party, although BIMCO would recommend the use of GENCON, COAL-OREVOY or GRAINCON.
