Richard Neylon

Richard Neylon is Partner at HFW in London. Richard specialises in shipping and crisis response. He acts for a range of shipowners, charterers and insurers, in wet and dry shipping disputes. A large proportion of Richard's work involves resolving disputes arising from marine casualties and he has been involved in many of the recent high profile incidents. He has particular experience of collisions, fires/explosions, salvage, piracy, capture/seizure, groundings and unsafe port claims – often involving complex multi-jurisdictional litigation and arbitration. Whilst he works in the Admiralty & Crisis Management department, the complexity of modern marine casualties necessarily involves him in a mix of wet and dry work. 

Jan Rindbo

Jan Rindbo is currently the Chief Executive Officer of Danish shipping company Dampskibsselskabet Norden A/S, a position he has held since 2015. He has extensive knowledge and experience in the industry, having worked in shipping for over 20 years in various positions that have taken him from Copenhagen to Hong Kong and the United States. Rindbo has attended various executive management training courses through INSEAD and Copenhagen Business School and hold directorships at the Danish trade and employer organisation Danish Shipping and BIMCO.

Toby Stephens

Toby is HFW’s Singapore Head of Shipping and APAC Head of our global Crisis Management team. Toby’s work involves managing major marine and energy disasters, which are often complex, involving a number of interrelated actions in a number of jurisdictions. He is also recognised for insurance coverage and other marine and energy related commercial and contractual disputes.  Toby has practical experience of working as a marine surveyor in Houston. He has also acted as head of the legal team at a leading Lloyd’s syndicate dealing with marine, energy and war risks.  Toby is qualified in England and Wales and joined HFW as a solicitor in 2001. He became a Partner in 2007 and relocated from our London office to Singapore in 2017.

Elinor Dautlich

Elinor is Partner at HFW and heads the global finance team.  She represents shipowners, operators, shipyards, designers and banks across the cruise, commercial shipping, yachts and business jets, LNG and offshore sectors. Elinor advises on all types of commercial shipping contracts including second-hand sale and purchase, shipbuilding contracts, EPC and EPCI contracts, ship recycling, ship registration, charterparties, pooling agreements, management agreements, seismic-related contracts, shares sale and purchase and joint venture agreements as well as on ship and aviation finance, leasing, seller's credits and other forms of capital raising. She also advises on contracts for the design, construction, purchase and operation of yachts and business jets. Elinor is part of the firm's LNG group, which has been responsible for drafting some of the first long-term LNG vessel charters and has, over the years, built up extensive experience of LNG time charters and related agreements, including joint venture arrangements, for some of the major LNG projects around the world. The group deals with all modern LNG time voyage and other specific charters, gas supply / offtake and LNG sale and purchase agreements, financing agreements, insurance issues, FLNG, FSRU projects and the construction and operation of LNG ports and terminals. Elinor has particular experience in the drafting of LNG charters and the ShellLNGTime form. Elinor has been advising on piracy related contracts since 2009, including contracts for the provision of private security services and, more recently, cyber security services and insurance. She sits on BIMCO's drafting sub-committees for GUARDCON and the new cyber security clauses.  Elinor lectures on commercial shipping matters, and in particular on shipbuilding and offshore construction topics, security in shipping and yachting, FPSO charters, LNG charters and FSRU contracts and related insurance issues. Elinor is recommended by the Legal 500 UK and Chambers directories. She co-leads the firm's travel and leisure group. Elinor is a former chair of the International Bar Association's Maritime and Land Transport Law Committee, sits on the UK Chamber of Shipping's Taxation Committee and is a member of WISTA. She has been with HFW since 1994. Elinor is qualified in England and Wales.

Punit Oza

Punit Oza is the Vice President & Head of Supramax Pacific of Klaveness Asia Pte Ltd. Punit Oza has over 23 years of experience in dry bulk shipping. He started his career at Precious Shipping PCL in Thailand in 1993. He then held a number of positions in the Middle and Far East and is currently the Vice President and Head of Supramax Pacific at Torvald Klaveness’ Singapore Regional Office. Punit is responsible for the entire Supramax Portfolio in the Asia Pacific region with a specialisation in the Indian and Thai markets. He is also a Fellow of Institute of Chartered Shipbrokers (FICS) and Chairman of the Singapore Branch as well as a member of Singapore Chamber of Maritime Arbitration (SCMA) and Maritime Law Association of Singapore (MLAS). Punit has a degree in Financial Management and Accounting from the University of Mumbai and an MSc in Shipping, Trade and Finance from City University (now CASS) Business School, London. He also has a LLB from the University of London.

Søren Larsen

Following his graduation from Copenhagen University and the Institute of Maritime Law, Søren Larsen joined BIMCO in August 1985. He was appointed Head of Department for Documentary and Legal Affairs in 1993 and became Deputy Secretary General, with primary responsibility for BIMCO’s documentary affairs, in 1999. From 2005 to 2009, Søren Larsen assumed particular overview of the Documentary, Security & International Affairs, and Services Departments at BIMCO and is currently primarily responsible for BIMCO’s Contracts & Clauses and Support & Advice departments. In addition, he represents BIMCO’s and shipowners’ interests in various international fora, such as the IMO, UNCITRAL, ICC and CMI and works closely with the Secretary General in the management of the BIMCO Secretariat. He has represented BIMCO at meetings with various government bodies in the United States.

Arrest clauses in charter parties are frequently one-sided with charterers having the right to terminate the charter party if the ship is not released within two or three days of an arrest. To provide a fairer allocation of risk and responsibility in the event of ship arrest BIMCO has developed two new standard clauses for time and voyage charter parties. Risk allocation is based on the “sphere of responsibilities” approach taken by the Court of Appeal of England and Wales in the "Global Santosh" judgment . Under this approach, a distinction is drawn between issues such as the management of the ship and its crew, which fall within the owners’ sphere of responsibility, and employment for use of the ship which falls within the charterers’ sphere of responsibility. This clause was published on 14 June 2019.
